Facts About Wisconsin OWI Laws

OWI charges in Wisconsin can be an overwhelming experience.  OWI, otherwise called a DUI, refers to allegations that a person drove or operated a motor vehicle while under the influence of an intoxicant. Wisconsin OWI laws are regulated under section 346.63 of the Wisconsin Statutes.  Wisconsin law establishes many different ways a person could be charged with a OWI. In general, Wisconsin makes it illegal to drive while under the influence of alcohol (or drugs) to the degree that the driver is incapable of driving safely.

It is also illegal in Wisconsin to drive with a BAC of .08 or more (BAC of 0.0 for under 21 years old).  Wisconsin prohibits operating a commercial motor vehicle with a BAC of .04 or higher.  For anyone with 2 or more prior drunk driving convictions, it is illegal to drive with a BAC of .02 or more.

Furthermore, it is illegal to drive with a detectable amount of a restricted controlled substance in the driver’s blood, and is also illegal to drive with any detectable amount of Delta-9-THC, the active ingredient in cannabis, aka marijuana.
