Facts About Credit Card Fraud in Wisconsin

Under Wisconsin law, Wis. Stat. 943.41(5)(b)(1), it is illegal to use or intend to use a credit card belonging to another person, without that person’s consent, for the purposes of obtaining money, goods, services or anything else of value.

Using a credit card without permission of the card holder is a serious offense in Wisconsin, for which the punishment depends on the amount of the transaction or attempted transaction.

Transaction Amount – Penalties

The penalties for credit card fraud in the state of Wisconsin and Illinois vary based on the circumstances of the offense. However, in the state of Wisconsin the following penalties for credit card fraud are typical.

$2,500 or less:

  • Class A misdemeanor
  • Max Jail: 180 days

$2,500 – $5,000:

  • Class I felony
  • Max Prison: 3.5 years

$5,000 – $10,000:

  • Class H felony
  • Max Prison: 6 years

$10,000 – or more:

  • Class G felony
  • Max Prison: 10 years

In determining whether to charge a fraudulent use of a credit card as a misdemeanor or felony, Wisconsin law not only examines the amount of each individual transaction, but also considers the total value of separate transactions within a six (6) month period. For instance, someone who commits 3 separate illegal transactions of $1,000, within a 6-month period, will be charged with a felony offense because the totals of the transactions in that 6-month period exceeded the misdemeanor threshold of $2,500.

Identity Theft in Wisconsin

In Wisconsin, it is illegal, under Wis. Stat. 943.201, to intentionally use or attempt to use another’s identity or identification documents to:

  • Obtain anything of value or benefit;
  • Avoid criminal or civil liability; or
  • Harm the reputation, property, or estate of the individual.
