Facts About Delivery of Controlled Substances in Wisconsin

- Knowingly;
- Delivered, distributed, and/or manufactured a controlled substance.
Engaging in the delivery or manufacturing of illegal drugs is a Felony offense. The type and quantity of drug determine the exact type of felony offense and sentencing range. However, engaging in the delivery or manufacturing of even a low quantity of drugs is enough to risk a significant length of incarceration.

The penalties for delivery of a controlled substance charges in the state of Wisconsin and Illinois vary based on the circumstances of the offense. However, in the state of Wisconsin the following penalties for delivery of a controlled substance are typical.

5 grams to 15 grams – Class E felony
- Max Prison: 15 years
- Max Fine: $50,000
15 grams to 40 grams – Class D felony
- Max Prison: 25 years
- Max Fine: $100,000
40 grams or more – Class C felony
- Max Prison: 40 years
- Max Fine: $100,000
